Council of State to discuss injunction by Golden Dawn

The Council of State (CoS) will discuss an injunction on Friday filed by extreme-right Golden Dawn (Chryssi Avgi) party against a ministerial decision suspending state and private funding for the party.

The plenary session of the CoS will examine whether it has the authority to examine the legality of the ministerial decision, which was signed in December 2013. In October, Parliament in a plenary session had voted to suspend funding of any party if the leadership or one-fifth of the deputies of a party are prosecuted on grounds of being a criminal organisation or acting like terrorists, which is an ongoing case currently.

In February 2014, the party filed an injunction on the grounds that the suspension - signed by the ministers of Finance, Interior and Justice - was unconstitutional and illegal and contravened the European Convention of Human Rights of the Council of Europe.

The CoS's injunctions committee had rejected a similar application by the party in May related to the parliamentary decision, on grounds that CoS is not authorised to rule on Parliament decisions.
